Civil and Commercial Litigation

The experience of our lawyers in contentious commercial and civil litigation spans over a number of years. Not only do we regularly represent multinationals and local corporations before the Supreme Court, High Courts of Pakistan and the subordinate District Courts, but also counsel Government functionaries on complex constitutional matters.

The spectrum of our litigation practice ranges from property law disputes, real estate and construction matters, constitutional petitions, white-collar crime, contractual disputes, intellectual property matters, employment disputes, taxation and customs duty assessments and liabilities, domestic and family disputes, shipping and admiralty, telecommunications, as well as media.

Corporate and Compliance

Our team works with and is affiliated with the dedicated corporate and commercial law firm i.e. MSB Consultants, on all matters related to corporate and compliance issues. This collected team of qualified lawyers believes in securing the most water-tight arrangements for clients in the most pro-commercial and risk-averse manner.

Contracts are at the very core of any corporate or commercial relationship, and our team can draft and advise over a wide variety of them, of a basic or highly complex nature. Our corporate team advises governmental organizations and all sectors of businesses from people in executive roles, to shareholders, investors and lenders.

Given that our firm is integrated into the legal and business fabric of Pakistan, as well as worldwide, we are a key player to advise on mergers and acquisitions, joint ventures, public company takeovers, venture capital, private equity and equity capital markets transactions. We also lead our clients through every step of the legal process, making sure that they are in the know and adequately advised.

Since a large proportion of our clients are local and foreign companies, we advise them on all aspects of the governance and administration of companies, including compliance with the SECP. In terms of compliance, some laws are fluid and not in stasis, and thus we help our local as well as foreign clients be notified of such changes that would affect their businesses, and offer dynamic solutions to retain the balance that work best for our clients’ needs and objectives.

We can deal with a wide array of issues in this area, including but not limited to National Accountability Bureau (NAB), money laundering, international banking fraud and illegal property transactions.

Intellectual Property

Intellectual Property refers to creations of the intellect for which a monopoly is assigned to designated owners by law. Intellectual Property Rights (IPRs) are the protections granted to the creators of IP, and include Trademarks, Copyrights, Patents, Industrial Design Rights, and in some jurisdictions, trade secrets. It is important to note that even artistic works including music and literature, as well as inventions, words, phrases, symbols, and designs can all be protected as intellectual property.

There is nothing more deflating than to see someone claiming your intellectual property/invention/discovery as theirs. Also, the risk of online theft and data breach has increased tenfold since the dawn of the digital paradigm. In light of the above statement, our attorneys offer a comprehensive range of legal services for the identification, development, acquisition and protection of intellectual property assets and related technology. Our advocates have represented various companies and individuals in relation to their IPRs and infringements, and have successfully obtained favorable orders from the Honorable Courts on behalf of our clients.

Compliance and Government Investigations

Our team of lawyers are adept at handling the entire spectrum of government enforcement cases that arise for our clients, ranging from policy making and training, to routine government summons/notices and agendas, and even to full blown crises, such as law-enforcement raids on organizations culpable of malpractices.

We fully support our clients during and after proceedings, in order to have the best possible results for them. On the whole, a key agenda of our dealings of these high-stakes’ governmental engagements is that we can maintain order and a lack of disruption to our clients’ businesses, as well as we can manage matters in the most subtle and private manner.

Tort and Clinical Negligence

Healthcare disputes can often turn ugly and lead to long-standing antagonism between the conflicting parties, if not resolved timely. Our team represents healthcare providers and hospitals in a number of capacities. Our lawyers are proficient at representing clients of medical negligence claims. Also, Pakistan’s leading hospitals regularly seek our advice and representation in relation to their contentious disputes. We are on hands to settle medical disputes, no matter how big or small.

Finally, we represent our clients in defending any claim in rem or in personam at the time of instituting proceedings at the competent courts.

We advise in insurance matters on the legal and regulatory framework applicable to our jurisdiction. We advise clients on insurance contracts and litigation on insurance claims, and our team of experienced advocates have particular expertise in handling bad faith and punitive damages claims. We also specialize in marine insurance.

Our cross-border work encompasses various industries, including, but not limited to, healthcare, technology, financial institutions, manufacturing and retail sectors, as well as litigation and compliance expertise. Due to the fact that a number of our clients are multinational, we have pursued a strategy of building relationships with leading law firms around the world to better serve these clients. We leverage these relationships to provide exceptional service to our clients for their cross-border needs. Our international work emphasizes cross-border mergers and acquisitions, government investigations, environmental compliance and all types of litigation.
